Legislative regulation of the issue

There is no direct indication in the federal legislation where it is impossible to fry barbecue, and where it is allowed to do it, it also does not contain the term "barbecue", there are only general prohibitions on the relative making of fires.

Most of the specific fire regulations on the rules and places for making fires contain precisely regional legislation.

Where can you not fry?

The ban on barbecue in the summer cottage is a certain generalization, it is not in the federal legislation. At the local level, on the basis of the law of the constituent entity of the Russian Federation, a special fire regime can be introduced for a certain period of time (usually in the summer), which will prohibit the making of fires, including on the territory of land plots that are in private ownership.

In addition, according to clause 8 of the Fire Safety Rules, it is forbidden to make fires in the forests between the melting of the snow cover and the establishment of stable rainy weather in the fall:

  • in coniferous young stands;
  • on the burnt places;
  • in areas of damaged forest;
  • on cutting areas not cleared of the remains of trees and harvested raw materials;
  • in places where there is dried grass;
  • under the canopy of trees.

The same paragraph establishes where you can make fires and, accordingly, fry kebabs in the forests. This is allowed in other places (not listed in clause 8 of the Rules) on sites separated by a fire-resistant mineralized strip at least half a meter wide. Here, a mineralized strip is understood to mean a strip cleared of the mineral soil layer.

Barbecue ban in Moscow, St. Petersburg and other regions

According to Art. 8.32 of the Code of Administrative Offenses of the Russian Federation, violation of fire safety requirements in forests is punishable by a fine, its amount is for individuals - from 1,500 to 3,000 rubles, for legal entities and officials the amount is much higher - from 50,000 to 200,000 and from 10,000 to 20,000 rubles, respectively. A violation committed during the period of the special regime (part 3 of article 8.32) will entail an even greater increase in the fine:

  • for officials: 20,000 - 40,000 rubles;
  • for legal entities: 300,000 - 500,000 rubles.

Violation of fire safety rules outside the forests in accordance with Art. 20.4 of the Code of Administrative Offenses of the Russian Federation also entails a fine:

  • for citizens: 2,000 - 3,000 rubles (regulatory authorities may limit themselves to a warning);
  • for officials: 6,000 - 15,000 rubles;
  • for legal entities: 150,000 - 200,000 rubles.

If violations are committed during the period of the special regime, the fine will be:

  • for citizens: 2,000 - 4,000 rubles;
  • for officials: 15,000 - 35,000 rubles;
  • for legal entities: 200,000 - 400,000 rubles.

Such places are determined by the Decree of the Government of the Russian Federation "On the approval of fire safety rules in forests." It is strictly forbidden to make fires and fry barbecue, including on barbecue grills:
  • in young coniferous forests;
  • on the burnt places;
  • in areas of damaged forest;
  • in places where felling took place and there are remains of trees or harvested wood;
  • on peatlands;
  • in places with dried grass;
  • under the crowns of trees;
  • in the reserves.

A special fire regime has been introduced. What does it mean?
