Most often, we receive questions about the possibility of teaching a subject that is not listed in the diploma of education. The answer to it is contained in section 5 "The main consequences of the introduction of professional standards." You need to see if the specialty you received belongs to the enlarged group of specialties according to the All-Russian Classifier.

Terms of introduction of professional standards

From January 1, 2017, the Order of the Ministry of Labor of October 18, 2013 No. 544n comes into force, which approves the professional standard "Teacher" ("pedagogical activity in the field of preschool, primary general, basic general, secondary general education(educator, teacher). This means that employers (heads of educational institutions) are obliged to apply it in the formation of personnel policy and in personnel management, in the organization of training and certification of employees, the conclusion of employment contracts, the development of job descriptions and the establishment of wage systems.

So far, two orders of the Ministry of Labor are known that postpone the introduction of professional standards in the educational sphere: order No. 745 dated December 15, 2016 “On amendments to the professional standard “Teacher” (which postpones the date of entry into force to September 1, 2019) and the order of the Ministry of Labor dated December 26, 2016 No. 835n “On Amendments to the Professional Standard “Teacher additional education children and adults” (who are postponing the entry of the professional standard to 01/01/2018). The orders, apparently, have not been registered with the Ministry of Justice, so it has not yet been possible to find their texts in the legal databases.

At the same time, Decree of the Government of the Russian Federation of June 27, 2016 No. 584 establishes a transitional period for all professional standards until January 1, 2020. Thus, until the beginning of 2020, the employer, in accordance with the plan for the transition to the professional standard approved by him, selects the document that is to be used in the educational institution. By the end of the transition period, plans should be implemented and all teaching staff educational institution must comply with the requirements of the professional standard.

It applies to teachers preschool institutions, initial and high school, system special education and learning.

The professional standard "Teacher" does NOT apply to teachers of additional education, psychologists, tutors, methodologists.

Responsibility for non-application of the professional standard

Responsibility for non-compliance with the requirements of professional standards is established by Art. 5.27 of the Code of Administrative Offenses of the Russian Federation "Violation of labor legislation and other regulatory legal acts containing labor law norms." In accordance with the provisions of the article, liability for a single violation is established in the form of a warning or the imposition of an administrative fine on officials in the amount of 1,000 to 5,000 rubles, and for legal entities from 30,000 to 50,000 rubles. In case of repeated violation, officials may be fined in the amount of 10,000 to 20,000 rubles. or disqualification for a period of 1 to 3 years. For legal entities, the fine increases to 50,000 - 70,000 rubles.

Feature of the terminology used

Under the qualification of an employee in Art. 195.1 of the Labor Code of the Russian Federation is understood as the level of knowledge, skills, professional skills and work experience of an employee. In turn, the professional standard is a characteristic of the qualifications necessary for an employee to carry out a certain type of work. professional activity, including the performance of a certain labor function.

In accordance with Decree of the Government of the Russian Federation of January 22, 2013 No. 23 “On the rules for the development, approval and application of professional standards”, the Ministry of Labor and Social Protection of the Russian Federation coordinates the development of standards (clause 2). Professional standards are applied by employers in the formation of personnel policy and in personnel management, in organizing training and certification of employees, developing job descriptions, rating work, assigning wage categories to employees and establishing wage systems (clause 25).

Order of the Ministry of Labor dated April 12, 2013 No. 148n “On Approval of Qualification Levels for the Development of Draft Professional Standards” approved the description of nine employee qualification levels. Level 5 (for educators) and Level 6 (for teachers) apply to teaching staff.

For each labor function in the professional standard, a code number is used. It consists of two components: letter designation and digital. The letter means the generalized labor function, and the figure means the labor function. The labor function, in turn, includes three components: labor actions, necessary knowledge and necessary skills. Thus, new requirements for the activities of teaching staff will be established in the description of the labor function in the professional standard instead of the previous Unified Qualification Handbook.

The main consequences of the introduction of professional standards

With the introduction of professional standards, only those employees who have studied in the relevant areas will be able to teach the relevant subjects and disciplines. However, it is not entirely clear what is meant by "direction". Some experts suggest that the direction should be understood as the exact correspondence of the direction of training and the discipline taught (a physicist will be able to teach only physics, but not computer science). Others point out that the direction is understood as an enlarged group in the understanding of the Order of the Ministry of Education and Science of September 12, 2013 N 1059 and the Order of the Ministry of Education and Science of September 12, 2013 N 1061. That is, a person who has received an education in the field of mathematics will be able to conduct all disciplines corresponding to mathematical and natural sciences, namely mathematics, physics, computer science, etc. Since, in accordance with paragraph 4 of the Order of the Ministry of Education and Science Russian Federation(Ministry of Education and Science of Russia) dated September 12, 2013 N 1059 Moscow "On approval of the procedure for the formation of lists of professions, specialties and areas of training" professions, specialties and areas of training related to one professional area, when forming the lists, are combined into enlarged groups of professions, specialties and areas of training. (Cm. All-Russian classifier specialties in education. Education will correspond to the subject being taught if it is in the same enlarged group with it. The enlarged group is indicated in the classifier by the 2nd and 3rd characters.)

It is highly controversial that teachers primary school will not be able to work as educators in preschool institutions and vice versa without additional retraining. Firstly, professional standards establish the same requirements for the education and training of the educator and teacher. Secondly, the differences between pedagogical activities for the implementation of programs before school education and the implementation of primary school education programs concerns only various job functions and skill levels.

It should be noted that in accordance with the Order of the Ministry of Labor of August 5, 2016 No. 422n “On Amending the Professional Standard “Teacher”, changes were made to the requirements for education and training. Now for a teacher, this is higher education or secondary vocational education within the enlarged groups of training areas higher education and specialties of secondary vocational education"Education and pedagogical sciences» or in the field corresponding to the subject taught, or higher education or secondary vocational education and additional vocational education in the field of activity in educational organization. And for the educator: higher education or secondary vocational education within the enlarged groups of areas of training of higher education and specialties of secondary vocational education "Education and Pedagogical Sciences", or higher education or secondary vocational education and additional vocational education in the direction of activity in an educational organization. Thus, the requirements were brought into line with the Unified Qualification Handbook. Thus, the widespread opinion that a teacher is required to have an education or retraining in the field of pedagogical sciences does not correspond to the latest version of the requirements of the professional standard.

A significant part of the activity, which was previously fixed in the Provisions on Incentives and additionally encouraged, is now a mandatory labor function of a teacher and must be paid from the salary. So, now the teacher is obliged to possess such competencies as working with gifted children, deviant children, those for whom Russian is not their native language, as well as competencies in the field of inclusive education. The teacher should be able to interact with other specialists: psychologists, speech pathologists, social workers, and also have ICT skills.

What local regulations will be amended in the process of introducing professional standards?

Regulations on attestation (due to the entry into force of the Federal Law “On Independent Assessment of Qualifications” and the need to conduct attestation in accordance with the requirements of professional standards);

Regulations on training (in connection with the change in the labor functions of a teacher);

Regulations on bonuses (on incentives) (in connection with the change in the labor functions of a teacher and the appearance among his mandatory functions of those for which incentive payments were previously supposed);

Regulations on structural divisions;

Staffing (in connection with the requirements for the qualifications of subject teachers, teachers elementary school, Russian language, mathematics);

Job descriptions (due to changes in job functions);

Employment contracts (due to changes in job functions and remuneration).

Is it possible to fire an employee who does not meet professional standards?

The provisions of labor law do not allow you to dismiss an employee just like that. If he does not meet the professional standard for the position he occupies, then he should be offered (if any) another position.

Also, the employer can send the employee for professional retraining. In accordance with Art. 196 of the Labor Code of the Russian Federation, training of employees and additional professional education of employees are carried out by the employer on the terms and in the manner determined by the collective agreement, agreements, labor contract. For employees undergoing training, the employer must create the necessary conditions for combining work with education, provide guarantees established by labor legislation and other regulatory legal acts containing labor law norms, a collective agreement, agreements, local regulations, an employment contract. It should be noted that the Ministry of Education and Science of the Russian Federation, together with the Trade Union of Workers public education and Science of the Russian Federation issued a letter No. 08-415 dated March 23, 2015 “On the implementation of the right of teachers to additional professional education”, which, in particular, states that “The employer does not have the right to oblige employees to carry out CPE at their own expense, including such conditions cannot be included in the relevant contracts. However, this letter is not normative act and is not mandatory.

If an employee refuses to be transferred to another position or undergo retraining, then nothing can be done with the employee until January 2020. At the same time, with the end of the transition period, all employees in the positions of teaching staff must comply with the requirements of the professional standard. Thus, from January 2020, an employee can be sent for an independent qualification assessment in order to obtain a certificate of conformity (the Federal Law “On Independent Qualification Assessment” comes into force on January 1, 2017).

An independent assessment of qualifications, if carried out at the direction of the employer, is carried out at the expense of the employer by the center for assessing qualifications. The specific procedure for conducting the assessment is approved by Decree of the Government of the Russian Federation of November 16, 2016 N 1204 “On approval of the Rules for the conduct by the qualification assessment center of an independent assessment of qualifications in the form of a professional exam”. Within thirty days, the applicant is issued a certificate of qualification (in case of successful passing the exam) or a conclusion on passing the qualification exam (in case of unsuccessful passing of the exam). IN currently certificates of qualification are of an indefinite nature.

Thus, if an employee received a certificate of compliance based on the results of an independent qualification assessment, then he cannot be dismissed from the organization on the basis of non-compliance with professional standards. At the same time, the concepts of “certification for compliance with the position held” and “certification for compliance with the professional standard” should not be confused. In the event that the teacher does not pass an independent qualification assessment, then he may be dismissed under Art. 81 part 3 "due to insufficient qualifications, confirmed by the results of certification."

Professional standards are documents of a new type that systematically provide up-to-date information on the requirements for qualifications necessary to perform certain types of labor activity. Professional standards (PS) began to be developed in Russia in the mid-1990s. The initiators of their creation were representatives of the business community. As part of the implementation of the Agreement on Cooperation between the Ministry of Education and Science of Russia and the Russian Union of Industrialists and Entrepreneurs (RSPP), it was recommended to use the developed and approved professional standards when creating the relevant state educational standards and professional educational programs. Considering a significant share state structures and organizations with state participation in the Russian economy in 2012, a political decision was made on the active entry of the state into the process of developing the national system of qualifications. Today, the creation of professional standards is coordinated by the Russian Ministry of Labor. Draft standards can be developed by associations of employers, employers, professional communities, self-regulatory organizations and other non-profit organizations with the participation of vocational education organizations and other interested organizations. The methodology for developing professional standards provides for their wide public discussion. Thus, the state-public format has replaced the public format for the development of professional standards. At the end of 2015, about 800 professional standards were adopted, but the developers plan to approve about 1200 professional standards. Professional standards are applied by employers in the formation of personnel policy and in personnel management, in the organization of training and certification of employees, the conclusion of employment contracts, the development of job descriptions and the establishment of wage systems from 01/01/2017. Professional standard of a pedagogical worker: basic provisions

The professional standard of a teacher of additional education contains:

    Description of the teacher's job functions.

    Special admission requirements.

    Information about the requirements for education, training and work experience of a pedagogical worker.

    The purpose of the employee.

Professional standard helps to competently conduct a personnel policy and manage employees. The document is used in the certification of a teacher, determining the amount of wages, preparing job descriptions and concluding labor agreements.

The professional standard of a teacher of additional education 2016 allows teachers who have passed mandatory or voluntary certification to work.

According to order No. 613n, the following requirements are imposed on the training and education of a teacher:

"Secondary vocational education - training programs for mid-level specialists or higher education - bachelor's degree, the focus (profile) of which, as a rule, corresponds to the direction of an additional general education program mastered by students or taught training course, discipline (module).

Additional vocational education - professional retraining, the focus (profile) of which corresponds to the focus of the additional general education program mastered by students, or the taught course, discipline (module).

In the absence of pedagogical education - additional professional Teacher Education; an additional professional program can be mastered after employment. Training in additional professional programs according to the profile is recommended pedagogical activity at least once every three years."

Professional standard: the need for implementation

The Ministry of Justice of the Russian Federation has developed a professional standard due to difficulties encountered in the process of determining the qualifications of a teacher. Some legislative norms were adopted more than 20 years ago. They are no longer relevant. To meet global trends, new standards are being introduced.

The norms adopted at the legislative level will help increase the responsibility and interest of employees. In order for them to be fully implemented, it is recommended to send employees to advanced training courses.

Proper use of the standard

For achievement high results you must adhere to the following rules:

    Do not use the professional standard as a strict regulation of the work of employees.

    Do not force employees to perform work that distracts them from their direct duties.

    Encourage employees to look for innovative solutions.

Standard but not standard

According to the professional standard, a teacher is obliged to:

    Recruit children for training according to the developed program.

    Select children for training according to the developed program (together with the commission).

    Motivate students.

    Develop measures to improve the equipment of the classroom.

    Prepare the required information materials.

    Counsel children and their parents.

    Help students, supervise them.

    Correct children's behavior.

    Understand the needs of students.

    Recruit groups of students, taking into account the characteristics of educational programs.

    Ensure the safety and proper use of consumables, equipment, etc.

    Create a comfortable environment for the development of children.

    Prepare students for participation in competitions, exhibitions and other similar events.

    To create conditions for the development of self-esteem and self-control of children.

    Collaborate with colleagues and maintain a positive environment.

To educational process proceeded according to the standard and at the same time non-standard teacher of additional education must have the following personality traits:

    High intellectual level.

    Understanding the needs of children.

According to the amendments made this year to Federal Law No. 273 “On Education in the Russian Federation”, in 2017 every teacher of additional education must undergo mandatory certification. This procedure shows the degree of skill of the employee. The teacher must provide evidence of his achievements: thanks, certificates, diplomas. According to the results of certification, he is assigned one or another qualification category. The result of certification can be challenged in court. Also, a special labor commission may be created to resolve the issue.

Minor changes that happened in 2016 do not cause problems. Everything is clear and doable. A professional standard is a characteristic of the qualifications an employee needs to carry out a certain type of professional activity. The professional standard regulates not so much labor relations between a specific employee and his employer (there are other documents for this, for example, an employment contract or an effective contract), but rather relations between the professional community and a citizen who would like to confirm his qualifications and become part of this professional community. This approach excludes the reduction of the professional standard to an updated version of the job description.

The development of a standard and thoughtful measures for its implementation in the future will make it possible to remove many contemporary issues:

The key idea of ​​the professional standard is the ability of a teacher to work with different categories of children, namely:

    Working with gifted children;

    Work in the context of the implementation of inclusive education programs;

    Working with migrant children;

    Working with children with developmental problems;

    Work with deviant, dependent, socially neglected children, including those with deviations in social behavior.

    Possess ICT competencies

For some of the teachers, the new requirements are not a problem, because they already use in their work the most modern methods. But someone will have to solve the problem of mastering in practice new labor actions for them, the necessary knowledge and skills.

We are well aware that not a single person can meet all the qualification requirements of labor functions recorded in the standard, and each manager has the right to focus on specific aspects of activity, depending on the characteristics of his educational organization. The standard allows you to place emphasis on different labor functions in the total scope of activities. In addition, no one requires the teacher, for example, to correct complex deviations in the behavior of the child, but his main task is to be able to recognize certain problems in time (whether it is a developmental delay or mental retardation or simply a lack of attention) in order to guide the child to the right specialist. Therefore, one of the main requirements of the standard is the ability to interact with other specialists: psychologists, social educators, defectologists, etc.

A professional standard can become a mechanism for personnel management, professional self-development, as it reflects the requirements for the effectiveness of pedagogical activity.

The professional standard can be used as a basis for the development of assessment materials, the content of qualification exams. In order to avoid ambiguity and subjectivity in the certification procedure, clearly defined, achievable and diagnosable tasks for each teacher and a clear mechanism for evaluating the results of their actions are necessary.

Standard requirements for the education of teachers

Requirements for a teacher of additional education:

higher education (bachelor's degree) or secondary vocational education in the direction of "Pedagogical education", as a rule, in the profile "Additional education (in the relevant field);

higher education (bachelor's degree) or secondary vocational education, corresponding to the profile of the circle, section, studio, club and other children's association, and additional professional education in the direction of "Pedagogical education".

Teaching staff are required to undergo training and testing of knowledge and skills in the field of labor protection in accordance with the procedure established by the legislation of the Russian Federation.

It is recommended to study in educational programs in the field of pedagogical activity at least once every three years.

The professional standard allows, based on general characteristics activities, "recruit" the functions of an individual employee. All the functions presented should not be performed by one generalist. They are distributed among all employees involved in the process.

The head of the organization ensures the performance of functions due to the rational staffing, by improving the skills of his employees, by adequately distributing areas of responsibility between them.

This approach allows you to get away from the situation of equating the qualifications of a young and experienced teacher, assigning identical functions to them and at the same time assuming that these functions will be performed at the same level of quality.

A professional standard is a tool for the formation of a new pedagogical culture, even more so - a public consciousness. The very activity of vocational education teachers is assessed from the standpoint of a competency-based approach - the teacher needs to demonstrate at certification how he copes with professional tasks; show your knowledge in the ways of activity.

The professional standard set a number of tasks for the teacher that he had not solved before. All this he must learn. After all, it is impossible to demand from a teacher that he does not know how.

  • Create a comfortable environment for the development of children.
  • Prepare students for participation in competitions, exhibitions and other similar events.

  • Collaborate with colleagues and maintain a positive environment.

In order for the educational process to proceed according to the standard and at the same time non-standard, the teacher of additional education must have the following personality traits:

According to the amendments made this year to Federal Law No. 273 “On Education in the Russian Federation”, in 2017 every teacher of additional education must undergo mandatory certification.
