The purpose of the final state certification is to establish the level of preparation of a university graduate to perform professional tasks in the specialty and the compliance of his preparation with the requirements of state standards. Such certification is carried out only in accredited universities (and their branches) for all major higher education programs.

Persons studying in institutions of higher education that do not have state accreditation or who have successfully completed them are entitled to current and final attestation in universities that have state accreditation on an external study basis.

The final certification of a university graduate is mandatory and is carried out after mastering educational program in full. In case of unsatisfactory completion of the final certification, the student, upon his personal application, can be provided within the period of mastering the main educational program of higher vocational education vacation, at the end of which students are expelled.

The types of attestation tests include: defense of the final qualifying work (defense of the graduation project) and state examinations.

Topics of diplomas are determined by the university. The student should be given the right to choose a final work up to the proposal of his subject with the necessary justification for its development (i.e. the student has the right to explain what topic he chose for his thesis, why, whether he has any experience on it, etc.). d.). Graduation qualification works are carried out in the form of a thesis or a graduation project. In preparing such work, the student is assigned a supervisor and consultants.

The composition of the final state certification must necessarily include the defense of the final work. An exception to this provision for certain specialties can only be made by the Russian Ministry of Education and Science.

The State Attestation Commission is headed by a chairman who organizes and controls the activities of all examination commissions, ensures the unity of the requirements for graduates. The chairman of the commission should be a person who does not work in this university, from among doctors of sciences, professors of the corresponding level, and in their absence - from among candidates of sciences or major specialists of any enterprise or organization. A representative of this university is also included in the commission as a deputy chairman of the commission. State commissions operate for one calendar year.

The defense of the thesis (with the exception of works on closed topics) is held at an open meeting of the examination committee with the participation of at least 2/3 of its composition.

results state exams and diploma defenses are determined by grades from "excellent" to "unsatisfactory" and are announced on the same day after the registration of the necessary protocols.

Re-passing of the final examinations can be appointed not earlier than three months and not more than five years after passing the final examinations for the first time. At the same time, repeated final tests cannot be assigned more than two times.

Persons who did not pass certification for a good reason (due to illness or in other cases) should be given the opportunity to pass these tests without being expelled from the university.

An educational institution, in accordance with a license, issues to persons who have passed the final certification documents on the relevant education and (or) qualifications in accordance with the license. The form of documents is determined by the educational institution itself. These documents are certified by the seal of the educational institution.

According to Art. 27 of the Law on Education, educational institutions that have state accreditation and implement general education (with the exception of preschool) and vocational educational programs issue to persons who have passed the final certification, state documents on the level of education and (or) qualifications, certified by the seal of the institution - diplomas.

The diploma is issued no later than 10 days after the date of the expulsion order.

The diploma with honors is issued to the graduate on the basis of all grades entered in the Diploma Supplement, including grades in disciplines, term papers, practices and the results of the final final exams. If a student applies for a red diploma, all state exams must be passed by him only with "excellent". And according to the current exams, there should be at least 75% of fives, the rest can be fours. Accounts are not included in this calculation.

A diploma of incomplete higher professional education is issued to students who have interrupted their studies and successfully completed part of the educational program for at least two years (ie, only after successfully completing two courses of the institute).

Persons who have not completed education at this level are issued an academic certificate of the established form (for example, such a certificate is issued to persons expelled from the first or second year of the university). Such a certificate can be issued to the student and upon his written application.

Qualifications indicated in documents on primary, secondary and higher professional education and in documents on postgraduate professional education, as well as degrees give the right to their holders to engage in professional activities, including holding positions for which mandatory qualification requirements and the corresponding educational qualification are determined in accordance with the established procedure.

In exchange for the lost diplomas of graduation from universities, duplicates of these documents are issued. If it is impossible to fill in a duplicate of the Diploma Supplement, a duplicate is issued without an application.

Persons who have changed their first name (surname, patronymic) may exchange their education documents for new ones with a new name (surname or patronymic). The exchange is made by the decision of the rector of the university on the basis of the application of the person who changed his name, etc. An old diploma and documents confirming the change of surname, name or patronymic are attached to such an application.

Certification (fr. , lat. attestatio- certificate, confirmation) - determination of qualifications, the level of knowledge and skills of something, as well as compliance with the requirements. In labor law, attestation is usually understood as verification vocational training employee and his business qualities in order to determine the level of his qualifications (establishment of a qualification category) and (or) compliance with the position held (work performed).

Evaluation of the employee's skill level and its suitability for the position held is made on the basis of predetermined objective criteria. As Yu.P. Orlovsky, A.F. Nurtdinova and L.A. Chikanova (“Handbook of the Personnel Officer: Legal Aspects”, 2011), discrimination is unacceptable during certification, i.e. establishing preferences or restrictions that are not related to the business qualities of the employee and the results of his work (Article 3 of the Labor Code of the Russian Federation). In the course of certification, the degree of compliance of the employee with the position held (work performed) is determined; prospects for using the employee's potential are identified; the degree of need for advanced training, professional training or retraining is determined. The conclusions of the attestation commission can serve as confirmation of the need for transfer to another job (position) or termination of the employment contract, the basis for sending the employee to advanced training courses, the use of incentives, higher wages, etc.

For most specialists, certification is carried out periodically, as a rule, at regular intervals - once every three to five years (paragraph 4 of the Decree of the Council of Ministers of the USSR of 07/26/1973 N 531 "On the introduction of certification of managers, engineering and technical workers and other specialists of enterprises and organizations industry, construction, Agriculture, transport and communications "(approved by the Decree of the State Committee for Science and Technology of the USSR N 470 and the State Committee for Labor of the USSR N 267 of 10/05/1973, as amended on 10/22/1979, as amended on 11/14/1986) - hereinafter the Regulation of 10/05/1973). You can select and "one-off"(one-time) certification, which is carried out at the initiative of the employer to resolve the issue of dismissal of an employee under subparagraph "b" of paragraph 3 of Art. 81 of the Labor Code of the Russian Federation.

Certification to resolve the issue of dismissal is carried out regardless of whether the employee is subject to periodic certification or not. This rule was introduced in order to make the decision to recognize an employee as inappropriate for the position (work performed) more democratic and objective. In particular, in order for the decision on non-compliance to be made not solely by the head, but by a special commission, which includes officials of the organization, specialists of the relevant profile, representatives of the trade union organization. According to Article 82 of the Labor Code of the Russian Federation, the dismissal of employees who are members of a trade union, on the grounds provided for in paragraphs 2, 3 or 5 of the first part of Article 81 of the Labor Code of the Russian Federation, is carried out taking into account the reasoned opinion of the elected body of the primary trade union organization in accordance with Article 373 of the Labor Code of the Russian Federation.

When determining the circle of employees subject to certification, it is necessary to take into account the special guarantees established for employees. These guarantees are aimed at protecting the employee from unreasonable decisions. In particular, the next certification does not pass:
persons who have worked in their position for less than two years;
pregnant women;
women and men who are on parental leave when they reach 3 years of age.

At the same time, in accordance with Art. 256 of the Labor Code of the Russian Federation, parental leave can be used not only by the mother, but also by the father, as well as other relatives of the child who are actually caring for him. The duration of leave can currently be almost three years (until the child reaches the age of three). Certification of these employees is possible not earlier than two years after their release from the specified holidays.

Certification of the teaching staff of higher educational institutions

According to Art. 49 federal law dated December 29, 2012 N 273-FZ "On Education in the Russian Federation" (as amended):

1. Certification of teaching staff is carried out in order to confirm the compliance of teaching staff with the positions they hold based on an assessment of their professional activity and at the request of teaching staff (with the exception of teaching staff from among the teaching staff) in order to establish a qualification category.

2. The certification of teaching staff in order to confirm the compliance of teaching staff with their positions is carried out once every five years on the basis of an assessment of their professional activities by certification commissions, independently formed organizations engaged in educational activities.

3. Carrying out attestation in order to establish the qualification category of pedagogical workers of organizations engaged in educational activities and being under the jurisdiction of federal executive authorities is carried out by attestation commissions formed by federal executive authorities in whose jurisdiction these organizations are, and in relation to pedagogical workers of organizations engaged in educational activities and are under the jurisdiction of the subject of the Russian Federation, pedagogical workers of municipal and private organizations engaged in educational activities, this attestation is carried out by attestation commissions formed by authorized state authorities of the constituent entities of the Russian Federation.

4. The procedure for attestation of teaching staff is established by the federal executive body that performs the functions of developing public policy and legal regulation in the field of education, in agreement with the federal executive body responsible for the development of state policy and legal regulation in the field of labor.

The main participants in the certification of teachers and researchers, notes Professor E.L. Bolotov in the article "Certification of scientific and pedagogical workers of the university" ("Lawyer of the University", N 2, February 2011), are:
employees of the teaching staff (Dean of the Faculty, Head of the Department, Professor, Associate Professor, Senior Lecturer, Lecturer, Assistant);
scientists (chief researcher, leading researcher, senior researcher, researcher, junior researcher, chief state expert on intellectual property, leading state expert on intellectual property, state expert on intellectual property category I, state expert on intellectual property II category, state expert on intellectual property);
members of the attestation commission (chairman of the commission, deputy chairman, secretary and members of the commission from among the heads of departments, heads of other structural divisions, highly qualified scientific and pedagogical workers, representatives of the personnel, legal services and the elected body of the relevant primary trade union organization).

When forming the attestation commission of an educational institution and organizing its work, the following requirements must be met:
the composition of the commission should not lead to a conflict of interests of participants in labor relations;
Commission meetings are held as attestation materials are received;
meetings of the commission are valid if two-thirds of its members and a representative of the elected body of the relevant primary trade union organization attend;
the decision of the commission is made by an open vote of a simple majority of the votes of the members of the attestation commission present at the meeting;
in case of an equal number of votes of the members of the attestation commission, the employee is recognized as corresponding to the position held;
the decision of the commission is communicated to the employee after summing up the voting results;
Materials of attestation of employees are transferred to the employer no later than five working days after the completion of the work of the commission.

The Certification Commission has the right to recognize the employee as appropriate or inappropriate for the position held, to note positive and (or) negative sides professional activities of the certified person, make motivated recommendations on the professional activities of the employee, including the need for advanced training. The formation of the commission is determined in the manner prescribed by the charter or acts of the self-government body of the educational institution and the regulation on the attestation commission. The head of the educational institution by order approves the personal composition and rules of work of the commission. The certified employee participates in the preparation of the certification and the meeting of the certification commission. For each employee, an individual certification period is set, reflected in a special schedule.

In accordance with the Order of the Ministry of Education and Science of the Russian Federation of July 28, 2014 N 795, participants create numerous documents during the certification activities.
Documents of the employer (clauses 9, 12, 17 of the provision):
1. Presentation of the department, which contains:
1) an objective and comprehensive assessment of the employee's activities, based on the qualification characteristics for the position held, containing job duties and requirements for the level of knowledge and qualifications corresponding to the category of the employee, as well as the provisions on the relevant structural unit and / or the charter of the institution;
2) a motivated assessment of the professional, business and personal qualities of the certified person, as well as the results of his professional activity.
2. Attestation sheet of the employee.
3. The attestation sheet and the presentation of the department (another structural unit) for the attestation period are stored in the employee's personal file.
Documents of the certified employee (clauses 10, 11, 13 of the provision):
1. List scientific papers by sections:
monographs and chapters in monographs;
articles in scientific collections and scientific periodicals, patents (certificates) for intellectual property;
publications in the materials of scientific events;
publications in registered scientific electronic publications;
preprints;
popular science books and articles.
2. Names of published educational publications or educational publications, in the preparation of which the certified person took part.
3. List teaching aids, curricula, work programs training courses, disciplines, modules, control and measuring materials, electronic educational resources, in the development of which the certified person took part.
4. Information about the volume teaching load, including the management of course and diploma projects, practitioners, scientific supervision of graduate students (adjuncts), advising doctoral students.
5. List of grants, contracts and contracts for research and development work in which the employee participated, indicating his specific role.
6. Information about the personal participation of the employee in scientific events (congresses, conferences, symposiums and other scientific events) indicating the status of the report (invited, plenary, sectional, poster) and the level of the event (international, all-Russian, regional).
7. Information about the participation of the employee in the editorial boards of scientific and pedagogical periodicals.
8. Information about the organization educational work with students.
9. Information about work in state attestation commissions, councils for the defense of doctoral and master's theses, expert councils The Higher Attestation Commission of the Ministry of Education and Science of the Russian Federation, other councils or commissions formed by federal executive bodies.
10. Information about prizes and awards for scientific and pedagogical activity.
11. Information about advanced training and other information.
12. Statement with appropriate justification about his disagreement with the presentation of the department (another structural unit).
13. Application of the employee to postpone the date of certification for a good reason.
14. Application of the employee on the conduct of certification in absentia in case of his absence at the meeting of the certification commission for a good reason.
Documents of the attestation commission (clauses 15, 16 of the provision):
1. Minutes of the meeting of the commission indicating one of the following decisions:
corresponds to the position held;
does not match the position.
2. Certification sheet based on the results of the current certification.

So, certification of scientific and pedagogical workers is carried out on the basis of a department (or other structural unit) on the basis of an objective and comprehensive assessment of their activities. It is based on the qualification characteristics for the position held by the employee, containing job duties and requirements for the level of knowledge and qualifications of the relevant categories of employees, as well as the regulation on the relevant structural unit and (or) the charter of the institution. The submission must contain a reasoned assessment of the professional, business and personal qualities of the person being certified, as well as the results of his professional activity. Inappropriate, poor-quality performance by a teacher of his duties cannot be based only on the judgments of his colleagues. Unsatisfactory reading of lectures, conducting seminars, performing scientific, methodological and educational work of a teacher at a low level should be recorded in the course of visiting classes by colleagues (in particular, members of the commission) with subsequent analysis of these classes at a meeting of the department in an open, collegiate manner, as well as in in the course of summing up the results of the teacher's work in various areas, not excluding expert assessments. The presentation of the department sent to the attestation commission must contain an objective and fair assessment of the teacher's work, reasonably accepted by the employees of the department (or other structural unit), taking into account the analysis of classes and summing up.

Not later than two weeks before the day of certification, the scientific and pedagogical worker must be familiarized against receipt with the presentation of the department (another structural unit) received by the certification commission. During all this time (from the moment of acquaintance to the day of certification), the employee has the right to submit to the commission information that additionally characterizes him labor activity for the period that has passed since the date of the previous certification (for primary certification - from the date of entry to work). The certified employee has the right to submit an application to the certification commission with appropriate justification about his disagreement with the presentation of the department (another structural unit).

At each subsequent certification, the employee's certification sheet with the data of the previous certification is also submitted to the commission. The result of the certification is entered in section IV "Certification" of the employee's personal card (form N T-2) * (6). The record is drawn up as follows: the date of certification, the decision of the commission: “corresponds to the position of the assistant professor of the department ...”, the number of the protocol, the date of the protocol, the reason: “the date and number of the order”.

Regulations on the procedure for attestation of employees holding positions of scientific and pedagogical workers, approved. Order of the Ministry of Education and Science of the Russian Federation of July 28, 2014 N 795, does not contain any instructions on the activities following the results of certification. However, designed to optimize the staffing of the organization, certification of scientific and pedagogical workers allows the employer to make decisions in accordance with Labor Code RF. Decisions can be varied, for example, leave the employee at the same workplace, transfer to another job, send him to training to improve his skills, fire him, etc. On the basis of the decision prepared by the certification commission, the head issues an order on measures following the results of the certification. According to the order on measures following the results of certification, the employer needs to prepare orders for each item: on transfers, incentives and other appointments.

The terms during which, based on the results of certification, the employer has the right to decide on the continuation, change or termination of labor relations with employees, are not established by the Labor Code. For example, in the Decree of the State Committee for Science and Technology of the USSR N 470, the State Committee for Labor of the USSR N 267 of 05.10.1973 "On approval of the Regulations on the procedure for attestation of managers, engineering and technical workers and other specialists of enterprises and organizations in industry, construction, agriculture, transport and communications" , which is applied to the extent that it does not contradict the Labor Code of the Russian Federation, and can be used as the basis for developing a local normative act on the procedure for attestation of employees in the organization, it is indicated that the head of the organization, taking into account the recommendations of the attestation commissions, within a period of not more than two months from the date of attestation, may decide to transfer an employee recognized by the results of attestation as not corresponding to the position held, to another job from his consent. If it is impossible to transfer an employee with his consent to another job, the head of the enterprise, organization may, within the same period, in accordance with the established procedure, terminate the employment contract with him. After the expiration of the specified period, the transfer of the employee to another job or termination of the employment contract with him based on the results of this certification is not allowed.

Hulio note: so, it was a theory, but in practice, if it came to certification of teaching staff, then it can be planned or unscheduled. Next, a conclusion is written about your compliance or non-compliance with the position held - assistant, senior lecturer or associate professor. Further, they either leave, or transfer to a lower one, or are fired (if there are no lower vacancies). But rarely. So it goes.

According to the results of certification, the employer identifies persons who do not correspond to the position held. If such persons have been identified, then it is possible to start preparing proposals for transferring the employee to other vacant positions or dismissal. According to paragraph 15 of the Regulations on the procedure for attestation of employees holding positions of scientific and pedagogical workers, in the event of an employee’s inconsistency with the position held due to insufficient qualifications, confirmed by the results of certification, the employment contract with him can be terminated in accordance with paragraph 3 of part 1 of Art. 81 of the Labor Code of the Russian Federation. According to clause 3. part 1 of article 81, the employment contract may be terminated by the employer in cases<...>non-compliance of the employee with the position held or the work performed due to insufficient qualifications, confirmed by the results of certification. Dismissal on the grounds provided for in paragraph 2 or 3 of part one of this article is allowed if it is impossible to transfer the employee with his written consent to another job available to the employer (as vacant position or work corresponding to the qualifications of the employee, as well as a vacant lower position or lower paid job) that the employee can perform taking into account his state of health. At the same time, the employer is obliged to offer the employee all the vacancies that meet the specified requirements that he has in the given area. The employer is obliged to offer vacancies in other localities, if it is provided for by the collective agreement, agreements, labor contract.

If the employee refuses the transfer offer, then an order is issued to terminate the employment contract in the unified form N T-8 and an entry is made in the personal card of form N T-2 and the work book, for example: “Dismissed due to inconsistency with the position held, due to insufficient qualifications confirmed by the results of certification, clause 3 of the first part of Art. 81 of the Labor Code of the Russian Federation”. The employee must be familiar with the dismissal order, which must be confirmed by his personal signature. He must also put his signature on the personal card of form N T-2, in the work book and in the book of accounting for the movement of work books and inserts to them.
If the employee does not agree with the dismissal procedure on this basis, then he can go to court. In this case, when the employee applies to the court, all the burdens of proving the fact that the employee does not comply with the position held are assigned to the employer. The defendant (employer) in such a situation must have all the documents listed above properly executed. For example, the necessary evidence in the case in the event that an employee who disagrees with the dismissal applies to the court may be:
a copy of the order on the employment of the plaintiff (an extract from the order on the employment of the plaintiff);
a copy of the order to dismiss the plaintiff from work (extract from the order to dismiss the plaintiff from work);
order for certification;
characteristics for the employee, prepared for the attestation commission; evidence of the fact that the employee was familiarized with the materials submitted to the attestation commission; other documents related to certification;
conclusion of the attestation commission;
documents on the duration of the work experience of the employee (work book);
certificate of the average salary of the plaintiff;
evidence confirming the plaintiff's refusal to transfer to another job;
evidence confirming that the administration does not have the opportunity to transfer the employee with his consent to another job.

Judicial practice, as noted by A.V. Zavgorodniy, in the article “Certification at the university: using experience” (magazine “Handbook of Personnel Officer”, 2010, No. 11), proceeds from the inadmissibility of terminating an employment contract due to insufficient qualifications with an employee who does not have the necessary production experience due to the short length of work experience. Since the conclusions of the commission are one of the types of evidence, they need to be carefully checked, and the court has the right to give an appropriate assessment to the conclusion of the commission, taking into account other evidence available in the case. Therefore, the conclusions of the attestation commission on the business qualities of the employee should be subject to evaluation in conjunction with other evidence in the case (paragraph 31 of the decision of the Plenum of the Supreme Court of the Russian Federation dated March 17, 2004 No. 2). Such evidence can be unsatisfactory reading of lectures, conducting seminars (practical) classes, performing scientific, methodological and educational work at a low professional level, as well as complaints from students.

During the consideration of the case, the court must examine all the documents on the basis of which the decision of the commission was made. When examining the materials (conclusions) of the attestation commission, the court not only discusses the conclusions of the commission on the qualifications of a scientific and pedagogical worker, but also checks compliance with the rules of the certification itself. Inconsistency with the position held does not imply the employee’s fault in his lack of sufficient qualifications, and if a dispute arises and is considered in court, the employer’s actions to bring employees to disciplinary liability will be recognized as unlawful, and the provisions of the local regulatory act on personnel certification will be invalidated on the basis of part four Art. 8 of the Labor Code of the Russian Federation. It should also be remembered that the decision of the certification commission is not binding on the employer, but is rather advisory in nature, which does not affect the employee's right to appeal the employer's decision in court.

Regulations on the procedure for attestation of employees holding positions of scientific and pedagogical workers

1. This Regulation on the procedure for attestation of employees holding the positions of scientific and pedagogical workers (hereinafter referred to as the Regulations) determines the procedure for attestation of employees holding the positions of scientific and pedagogical workers of organizations implementing educational programs of higher education and additional professional education (hereinafter, respectively, employees , certified, organizations).

2. Certification of employees may be carried out before the expiration of the term for election by competition, provided for in part three of Article 332 of the Labor Code of the Russian Federation 1, or during the term of a fixed-term employment contract.

3. Certification is carried out in order to confirm the compliance of employees with the positions they hold based on an assessment of their professional activities.

The certification is designed to help rational use educational and creative potential of employees; their professional level; optimizing the selection and placement of personnel.

4. When conducting certification of persons holding positions of the teaching staff, the following should be objectively assessed:

results of scientific and pedagogical activity of employees in their dynamics;

personal contribution to improving the quality of education in the disciplines taught, to the development of science, to solving scientific problems in the relevant field of knowledge;

participation in the development of methods of teaching and educating students, in the development of new educational technologies;

5. When conducting certification of persons holding positions of scientific workers, the following should be objectively assessed:

results scientific activity employees in their dynamics for the period preceding certification;

personal contribution to the development of science, solving scientific problems in the relevant field of knowledge;

professional development.

6. Certification is not subject to:

employees who have worked in their position for less than two years;

pregnant women;

women on maternity leave; employees who are on parental leave until the child reaches the age of three.

Certification of employees specified in the fourth paragraph of this paragraph is possible not earlier than two years after their release from the specified holidays.

7. To carry out the certification of employees in the organization, an certification commission is formed. The procedure for the formation and regulation of the activities of the attestation commission are determined by the organization. At the same time, the composition of the certification commission is formed taking into account the need to exclude the possibility of a conflict of interest, which could affect the decisions made by the certification commission.

If necessary, in the case of a large number of certified employees or depending on the specifics of the activities of the certified employees, as well as if the organization has separate structural divisions, it is allowed to form several certification commissions.

The composition of the attestation commission must include a representative of the elected body of the relevant primary trade union organization or other representative body of workers (if such a representative body exists).

8. Meetings of the attestation commission are held as attestation materials are received.

9. The decision to conduct attestation of employees, the date, place and time of the attestation is made by the head of the organization (the person authorized by him) and is brought to the attention of the employees subject to attestation in writing no later than 30 calendar days before the day of the attestation.

10. Certification of an employee is carried out taking into account the representation of the structural unit (hereinafter referred to as the representation) in which the person being certified works, on the basis of an objective and comprehensive assessment of his activities.

The submission is subject to transfer to the certification commission and must contain a reasoned assessment of the professional and business qualities of the person being certified, as well as the results of his labor activity.

The head of the structural unit in which the certified person works is obliged to familiarize the employee with the submission against signature no later than 30 calendar days before the day of the certification.

If the employee refuses to familiarize himself with the submission, an act is drawn up, which is signed by the head of the organization (a person authorized by him) and the persons (at least two) in whose presence the act is drawn up.

11. Not later than 14 calendar days before the date of certification, the employee has the right to submit to the certification commission information characterizing his labor activity, including:

a) list of scientific papers by sections:

monographs and chapters in monographs;

articles in scientific collections and scientific periodicals, patents (certificates) for intellectual property;

publications in the materials of scientific events;

publications in registered scientific electronic editions;

preprints;

popular science books and articles;

b) the names of the educational publications prepared by the certified and published or educational publications, in the preparation of which the certified took part;

c) a list of teaching aids, curricula, work programs subjects, courses, disciplines (modules), electronic educational resources, in the development of which the certified person took part;

d) information about the amount of teaching load;

e) a list of grants, contracts and (or) agreements for research and development work in which the employee participated, indicating his specific role;

f) information about the personal participation of the employee in scientific events (congresses, conferences, symposiums and other scientific events), indicating the status of the report and the level of the event;

g) information about the participation of the employee in the editorial boards of scientific and pedagogical periodicals;

h) information about the organization of educational work with students;

i) information about prizes and awards in the fields of education and science;

j) information on advanced training, professional retraining;

k) a statement substantiating their disagreement with the presentation of the structural unit;

l) other information.

12. An employee has the right to be present at a meeting of the attestation commission during his attestation.

The absence of an employee at a meeting of the attestation commission is not an obstacle to the attestation.

13. The meeting of the attestation commission is considered competent if at least two thirds of its members are present.

The certification committee makes one of the following decisions:

corresponds to the position held;

does not match the position.

The decision of the attestation commission is made in the absence of the attested employee by open voting by a simple majority of votes of the members of the attestation commission present at the meeting and is drawn up in a protocol. In case of an equal number of votes, the employee is recognized as corresponding to the position held.

When attesting an employee who is a member of the certification commission, the decision of the certification commission is made in the absence of the certified employee in the general manner.

The results of the certification of employees are recorded in the protocol, which is stored with the submissions, information specified in paragraph 11 of this Regulation (if any), in the organization.

An extract from the minutes of the meeting of the attestation commission, containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the attestation commission, the results of voting, the decision taken by the attestation commission, is drawn up and issued to the employee against signature within 10 working days from day of the meeting.

14. The employee has the right to appeal the results of certification in accordance with the legislation of the Russian Federation.

15. Materials for the certification of employees are transferred by the certification commission to the organization no later than 5 working days from the date of the meeting of the certification commission to organize storage and make decisions in accordance with the Labor Code of the Russian Federation.

1. Approve, in agreement with the Ministry of Labor and Social Protection of the Russian Federation, the attached Procedure for the certification of teaching staff of organizations engaged in educational activities.

2. Establish that the qualification categories established for teaching staff of state and municipal educational institutions until the approval of the Procedure specified in paragraph 1 of this order, are stored for the period for which they were established.

3. Recognize invalid the order of the Ministry of Education and Science of the Russian Federation dated March 24, 2010 No. 209 "On the Procedure for Attestation of Teachers of State and Municipal Educational Institutions" (registered by the Ministry of Justice of the Russian Federation on April 26, 2010, registration No. 16999).

ORDER
CERTIFICATION OF PEDAGOGICAL STAFF OF ORGANIZATIONS,
CARRYING OUT EDUCATIONAL ACTIVITIES

I. General provisions

1. The procedure for attestation of pedagogical workers of organizations engaged in educational activities (hereinafter referred to as the organization) determines the rules, main tasks and principles for attestation of pedagogical workers of organizations.

This Procedure applies to teaching staff of organizations filling positions named in subsection 2 of section I of the nomenclature of positions of teaching staff of organizations engaged in educational activities, positions of managers educational organizations, approved by Decree of the Government of the Russian Federation of August 8, 2013 No. 678 (Sobraniye Zakonodatelstva Rossiyskoy Federatsii, 2013, No. 33, Art. 4381), including in cases where the filling of positions is carried out part-time in the same or another organization, and also by combining positions along with work in the same organization, defined by an employment contract (hereinafter referred to as teaching staff).

2. Certification of teaching staff is carried out in order to confirm the compliance of teaching staff with their positions based on an assessment of their professional activities and at the request of teaching staff (with the exception of teaching staff from among the teaching staff) in order to establish a qualification category * (1).

3. The main tasks of certification are:

stimulation of purposeful, continuous improvement of the level of qualification of pedagogical workers, their methodological culture, professional and personal growth;

determining the need for advanced training of teaching staff;

improving the efficiency and quality of teaching activities;

identifying prospects for using the potential of teaching staff;

taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of organizations;

ensuring the differentiation of wages for teachers, taking into account the established qualification category and the volume of their teaching (pedagogical) work.

4. The main principles of certification are collegiality, publicity, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during certification.

II. Certification of teaching staff in order to confirm compliance with the position held

5. Certification of teaching staff in order to confirm the compliance of teaching staff with their positions is carried out once every five years on the basis of an assessment of their professional activities by certification commissions, independently formed organizations (hereinafter referred to as the certification commission of the organization) * (2).

6. The attestation commission of the organization is created by the administrative act of the employer, consisting of the chairman of the commission, deputy chairman, secretary and members of the commission.

7. The composition of the attestation commission of the organization must include a representative of the elected body of the relevant primary trade union organization (if such a body exists).

8. Certification of teaching staff is carried out in accordance with the administrative act of the employer.

9. The employer introduces the teaching staff with the administrative act containing the list of employees of the organization subject to certification, the certification schedule, against signature at least 30 calendar days before the day of their certification according to the schedule.

10. To conduct certification for each teacher, the employer submits a submission to the certification commission of the organization.

11. The submission contains the following information about the teacher:

a) last name, first name, patronymic (if any);

b) the name of the position on the date of certification;

c) the date of conclusion of an employment contract for this position;

d) the level of education and (or) qualifications in the specialty or field of study;

e) information on obtaining additional professional education in the field of pedagogical activity;

f) the results of previous certifications (if any);

g) a motivated comprehensive and objective assessment of professional, business qualities, the results of the professional activity of a pedagogical worker in the performance of labor duties assigned to him by an employment contract.

12. The employer acquaints the teacher with the submission against signature no later than 30 calendar days before the day of the certification. After reviewing the submission, the pedagogical worker, if desired, may submit to the certification commission of the organization additional information characterizing his professional activities for the period from the date of the previous certification (for primary certification - from the date of employment).

If the teacher refuses to get acquainted with the presentation, an act is drawn up, which is signed by the employer and the persons (at least two) in whose presence the act is drawn up.

13. Certification is carried out at a meeting of the certification commission of the organization with the participation of a teacher.

The meeting of the attestation commission of the organization is considered competent if at least two thirds of the total number of members of the attestation commission of the organization are present.

In the absence of a pedagogical worker on the day of the certification at a meeting of the certification commission of the organization for good reasons, his certification is postponed to another date, and appropriate changes are made to the certification schedule, about which the employer informs the employee against signature at least 30 calendar days before the new date carrying out its certification.

If a teacher fails to appear at a meeting of the attestation commission of the organization without a good reason, the attestation commission of the organization conducts certification in his absence.

14. The attestation commission of the organization considers the submission, additional information submitted by the teacher himself, characterizing his professional activity (if presented).

15. Based on the results of the certification of a teacher, the certification commission of the organization makes one of the following decisions:

corresponds to the position held (the position of the pedagogical worker is indicated);

does not correspond to the position held (the position of the pedagogical worker is indicated).

16. The decision is made by the attestation commission of the organization in the absence of the certified teacher by open voting by a majority vote of the members of the attestation commission of the organization present at the meeting.

When passing the certification, a teacher who is a member of the certification commission of the organization does not participate in the voting on his candidacy.

17. In cases where at least half of the members of the attestation commission of the organization present at the meeting voted for the decision on the compliance of the employee with the position held, the teacher is recognized as appropriate for the position held.

18. The results of the attestation of a teacher who is directly present at a meeting of the attestation commission of the organization are communicated to him after summing up the voting results.

19. The results of the certification of teachers are recorded in a protocol signed by the chairman, deputy chairman, secretary and members of the certification commission of the organization who were present at the meeting, which is stored with submissions, additional information provided by the teachers themselves, characterizing their professional activities (if any) , at the employer.

20. For a teacher who has passed certification, no later than two working days from the date of its conduct by the secretary of the certification commission of the organization, an extract from the protocol is drawn up containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the certification commission of the organization , voting results, on the decision adopted by the attestation commission of the organization. The employer acquaints the teacher with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

21. The results of certification in order to confirm the compliance of teachers with their positions on the basis of assessment and professional activity, the teacher has the right to appeal in accordance with the legislation of the Russian Federation.

22. Certification in order to confirm compliance with the position held does not pass the following teaching staff:

a) teaching staff with qualification categories;

b) who have worked in their position for less than two years in the organization in which certification is carried out;

c) pregnant women;

d) women on maternity leave;

e) persons on parental leave until the child reaches the age of three;

f) absent from the workplace for more than four consecutive months due to illness.

Certification of pedagogical workers, provided for in subparagraphs "d" and "e" of this paragraph, is possible no earlier than two years after their release from the specified holidays.

Certification of pedagogical workers, provided for in subparagraph "e" of this paragraph, is possible not earlier than one year after their entry into work.

23. Attestation commissions of organizations give recommendations to the employer on the possibility of appointing persons to the relevant positions of pedagogical workers who do not have special training or work experience established in the “Qualification Requirements” section of the “Qualification Characteristics of the Positions of Educational Workers” section of the Unified Qualification Directory for the positions of managers, specialists and employees *(3) and (or) professional standards, but having sufficient practical experience and competence, performing qualitatively and in full the duties assigned to them.

III. Certification of teaching staff in order to establish a qualification category

24. Certification of teaching staff in order to establish a qualification category is carried out at their request.

According to the results of certification, the first or highest qualification category is established for teaching staff.

25. Certification of pedagogical workers of organizations under the jurisdiction of federal executive bodies is carried out by attestation commissions formed by federal executive authorities in whose jurisdiction these organizations are, and in relation to pedagogical workers of organizations under the jurisdiction of a constituent entity of the Russian Federation, pedagogical workers of municipal and private organizations, this attestation is carried out by attestation commissions formed by authorized state authorities of the constituent entities of the Russian Federation (hereinafter referred to as attestation commissions) * (4).

26. When forming attestation commissions, their composition, work regulations, as well as the conditions for attracting specialists to carry out a comprehensive analysis of the professional activities of teaching staff are determined.

The composition of the attestation commissions includes a representative of the relevant trade union.

27. Certification of teachers is carried out on the basis of their applications submitted directly to the certification commission, or sent by teachers to the certification commission by mail with a letter of receipt or with a notification in the form of an electronic document using public information and telecommunication networks, including including the Internet.

28. In the application for certification, pedagogical workers indicate the qualification categories and positions for which they wish to be certified.

29. Applications for attestation are submitted by teaching staff, regardless of the length of work in the organization, including while on parental leave.

30. Applications for certification in order to establish the highest qualification category for the position for which certification will be carried out for the first time are submitted by teachers no earlier than two years after the establishment of the first qualification category for this position.

31. The expiration of the highest qualification category does not limit the right of a teacher to subsequently apply to the certification commission with an application for his certification in order to establish the highest qualification category for the same position.

32. Applications of teachers for attestation are considered by attestation commissions within a period of not more than 30 calendar days from the date of their receipt, during which:

a) a specific term for the certification is determined for each teacher individually, taking into account the validity period of the previously established qualification category;

b) a written notification of teaching staff about the date and place of their certification is carried out.

33. The duration of certification for each teacher from the beginning of its implementation and until the decision of the certification commission is no more than 60 calendar days.

34. The meeting of the attestation commission is considered competent if it is attended by at least two thirds of the total number of its members.

35. The pedagogical worker has the right to personally be present during his certification at a meeting of the certification commission. If a teacher does not appear at a meeting of the attestation commission, attestation is carried out in his absence.

stable positive results in the development of educational programs by students based on the results of monitoring conducted by the organization;

stable positive results in the development of educational programs by students based on the results of monitoring the education system, carried out in the manner established by the Decree of the Government of the Russian Federation dated August 5, 2013 No. 662 * (5);

identifying the development of students' abilities for scientific (intellectual), creative, physical culture and sports activities;

personal contribution to improving the quality of education, improving the methods of training and education, broadcasting experience in the teaching staff of the practical results of their professional activities, active participation in the work of methodological associations of pedagogical workers of the organization.

achievement by students of positive dynamics of the results of mastering educational programs based on the results of monitoring conducted by the organization;

achievement by students of positive results in the development of educational programs based on the results of monitoring the education system, carried out in the manner established by the Decree of the Government of the Russian Federation of August 5, 2013 No. 662 * (5);

identifying and developing students' abilities for scientific (intellectual), creative, physical culture and sports activities, as well as their participation in olympiads, competitions, festivals, competitions;

personal contribution to improving the quality of education, improving teaching and upbringing methods, and the productive use of new educational technologies, broadcasting in teaching staff the experience of the practical results of their professional activities, including experimental and innovative;

active participation in the work of methodological associations of pedagogical workers of organizations, in the development of program and methodological support educational process, professional competitions.

38. Evaluation of the professional activities of teachers in order to establish a qualification category is carried out by the certification commission based on the results of their work, provided for in paragraphs 36 and 37 of this Procedure, provided that their activities are related to the relevant areas of work.

39. Based on the results of certification, the certification commission makes one of the following decisions:

establish the first (highest) qualification category (the position of the pedagogical worker for which the qualification category is established is indicated);

refuse to establish the first (highest) qualification category (the position for which the teacher is denied the establishment of a qualification category is indicated).

40. The decision of the attestation commission is made in the absence of the attested teacher by open voting by a majority vote of the members of the attestation commission present at the meeting. In case of equality of votes, the attestation commission makes a decision to establish the first (highest) qualification category.

When passing the attestation, a teacher who is a member of the attestation commission does not participate in the voting on his candidacy.

The results of the attestation of a teacher directly present at a meeting of the attestation commission are communicated to him after summing up the voting results.

41. The decision of the attestation commission is drawn up in a protocol, which is signed by the chairman, deputy chairman, secretary and members of the attestation commission who took part in the voting.

The decision of the attestation commission comes into force from the date of its issuance.

42. When a decision of the attestation commission to refuse to establish the highest qualification category is made in relation to a teacher with the first qualification category, the first qualification category is retained for him until its expiration.

43. Pedagogical workers who, during certification, were denied the establishment of a qualification category, apply at their request to the certification commission with an application for certification for the same qualification category no earlier than one year from the date the certification commission made the appropriate decision.

44. Based on the decisions of the attestation commissions on the results of the attestation of pedagogical workers, the relevant federal executive authorities or authorized state authorities of the constituent entities of the Russian Federation issue administrative acts on the establishment of pedagogical workers of the first or highest qualification category from the date of the decision of the attestation commission, which are posted on the official websites of the specified bodies on the Internet.

45. The results of certification in order to establish a qualification category (first or highest), a teacher has the right to appeal in accordance with the legislation of the Russian Federation.

46. ​​The qualification categories established for teaching staff are retained until the expiration of their validity upon transfer to another organization, including one located in another subject of the Russian Federation.

The license fixes the control standards, the maximum number of students and the validity period of this license.

The certificate of state accreditation of the university confirms the level of educational programs being implemented (higher professional education), the compliance of the content and quality of training of graduates in accredited programs with the requirements of state educational standards, the right to issue state documents to graduates on the appropriate level of education, i.e. constant quality control educational services provided by law only in accredited universities. Universities are accredited for a period not exceeding 5 years. The appendix to the certificate indicates the accredited programs of all levels of education implemented by the university, as well as the levels of education, qualifications (degrees) that will be awarded to graduates, the name and location of branches, a list of accredited programs implemented in each branch. A certificate without an attachment is not valid. Familiarization of an applicant with a certificate of state accreditation in the field of study (specialty) chosen by him or the fact of the absence of this certificate is recorded in admission papers and certified by the personal signature of the applicant.

Attestation of a higher educational institution is carried out by the state certification service at the request of a higher educational institution or at the initiative of the federal (central) body for managing higher professional education, federal executive authorities, bodies local government in charge of the higher education institution.

Licensing, attestation and accreditation of a higher educational institution

Licenses to conduct educational activities in educational programs of higher and postgraduate professional education are issued by the federal (central) governing body of higher professional education based on the conclusions of an expert commission.

The subject and content of the examination is the establishment of compliance with the conditions for the implementation of the educational process offered to higher educational institutions, the requirements of state authorities of the Russian Federation and local governments for the provision of educational space, sanitary and hygienic standards, health protection of students and employees of educational institutions, equipment of educational premises, equipment educational process and educational qualification of pedagogical workers.

Licensing of the educational activities of a higher educational institution in new areas of training (specialties) is carried out on a general basis, regardless of whether the higher educational institution has a license.

Licenses to conduct educational activities in military professional educational programs are issued only to state higher educational institutions in the manner established by the Government of the Russian Federation.

Licenses to higher educational institutions, regardless of their organizational and legal forms, with the exception of educational institutions additional education, can be issued only if they have the rights of the owner, operational management, lease or independent disposal of the necessary educational and material base.

REGULATIONS ON THE FINAL STATE CERTIFICATION OF GRADUATES OF HIGHER EDUCATIONAL INSTITUTIONS OF THE RUSSIAN FEDERATION

In accordance with the Law of the Russian Federation "On Education" (Bulletin of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1992, N 30, Art. 1797; Collection of Legislation of the Russian Federation, 1996, N 3, Art. 150; 1997, N 47 , Art. 5341; 2000, N 30, Art. 3120, N 33, Art. 3348; 2002, N 7, Art. 631, N 12, Art. 1093, N 26, Art. ) the development of educational programs of higher professional education ends with a mandatory final certification of graduates.

The Regulation on the final state certification of graduates of higher educational institutions of the Russian Federation (hereinafter referred to as the Regulation) applies to graduates studying in all forms of higher professional education.

For the final certification of graduates of non-accredited higher educational institutions implementing the main educational programs of higher professional education in accordance with the license, this Regulation is exemplary.

The final state certification of graduates who have completed their studies in higher educational institutions in educational programs of basic general, secondary (complete) general, primary and secondary vocational education is carried out in accordance with the provisions on the final state certification of graduates of educational institutions of the corresponding types and types.

I. General provisions

1. The purpose of the final state attestation is to establish the level of preparation of a graduate of a higher educational institution for the performance of professional tasks and the compliance of his preparation with the requirements of the state educational standard of higher professional education (including federal, national-regional and component of an educational institution).

2. The final state certification of graduates is carried out in accredited higher educational institutions (and their branches) for all major educational programs of higher professional education that have state accreditation.

A person who has successfully completed in full the development of the main educational program in the direction of training (specialty) of higher professional education, developed by a higher educational institution in accordance with the requirements of the state educational standard of higher professional education, is allowed to the final attestation tests, which are part of the final state certification.

Subject to successful completion of all established types of final attestation tests included in the final state certification, a graduate of a higher educational institution is assigned an appropriate qualification (degree) and a state diploma of higher professional education is issued.

3. Persons studying in higher educational institutions that do not have state accreditation or who have successfully completed them are entitled to current and final state attestation in higher educational institutions that have state accreditation, on the terms of an external student.

External studies in state and municipal higher educational institutions are carried out in the manner prescribed by the Regulations on external studies in state, municipal higher educational institutions of the Russian Federation dated October 14, 1997 N 2033, registered with the Ministry of Justice of Russia on October 30, 1997 N 1403.

II. Types of final certification tests

4. The types of final certification tests of the final state certification of graduates of higher educational institutions include:

defense of the final qualifying work;

State exam.

A specific list of mandatory final certification tests is established by the state educational standard of higher professional education in terms of the requirements for the final state certification of a graduate and is approved by the Russian Ministry of Education.*

* For students studying according to the state educational standards of higher professional education, put into effect before 1997, a specific list of mandatory final attestation tests is established by the higher educational institution. In this case, the final qualifying work is mandatory.

5. Final qualifying works are performed in the forms corresponding to certain levels of higher professional education: for the qualification (degree) bachelor - in the form of a bachelor's work; for qualification" certified specialist"- in the form of a thesis (project); for qualification (degree) master - in the form of a master's thesis.

6. Topics of graduation qualification works are determined by the higher educational institution. The student may be given the right to choose the topic of the final qualifying work in the manner prescribed by the higher educational institution, up to suggesting his own topic with the necessary justification for the expediency of its development. To prepare the final qualifying work, the student is assigned a supervisor and, if necessary, consultants.

Bachelor's works can be based on a generalization of completed term papers and projects and prepare for defense in the final period of theoretical training.

Graduation papers completed upon completion of the main educational programs for the training of specialists and masters are subject to review. The procedure for reviewing is established by the higher education institution.

7. The conditions and terms for the completion of graduation qualification works are established by the academic council of a higher educational institution on the basis of these Regulations, the relevant state educational standards of higher professional education in terms of the requirements for the final state certification of graduates, and the recommendations of educational and methodological associations of higher educational institutions.

8. Programs of state exams (for individual disciplines, the final interdisciplinary exam in areas of training (specialties), etc.) and the criteria for evaluating final qualification works are approved by the higher education institution, taking into account the recommendations of educational and methodological associations of universities.

The final attestation tests included in the list of mandatory final attestation tests cannot be replaced by an assessment of the quality of mastering educational programs through the implementation of current control progress and intermediate certification of the student.

III. State attestation commissions

9. The State Attestation Commission is headed by a chairman who organizes and controls the activities of all examination commissions, ensures the unity of the requirements for graduates.

As a rule, the chairman of the state attestation commission is approved by a person who does not work in this higher educational institution, from among doctors of sciences, professors of the corresponding profile, and in their absence - candidates of sciences or major specialists of enterprises, organizations, institutions that are consumers of personnel of this profile. If necessary, the chairman of the state attestation commission must meet the requirements for specialists related to work on closed topics.

The chairman of the state attestation commission is approved by the federal executive body in charge of the institution of higher education. For non-state and municipal higher educational institutions that have state accreditation, as well as state higher educational institutions that are under the jurisdiction of the constituent entities of the Russian Federation, the chairmen of state attestation commissions are approved by the Ministry of Education of the Russian Federation on the proposal of the founder (founders).

The chairman of the state attestation commission may head one of the examination commissions and take part in the work of any of them as a member.

State attestation commissions operate for one calendar year.

10. To conduct the final state certification in a higher educational institution, a branch of the university, the rector of a higher educational institution forms (after the approval of the chairman of the state certification commission in accordance with paragraph 9 of this Regulation) state certification commissions for each main educational program of higher professional education.

11. State attestation commissions are guided in their activities by this Regulation, the relevant state educational standards of higher professional education in terms of the requirements for the final state certification, educational and methodological documentation developed by higher educational institutions on the basis of state educational standards in the areas of training and specialties of higher professional education, and guidelines educational and methodological associations of higher educational institutions.

The main functions of the state attestation commission are:

determination of the conformity of the graduate's training with the requirements of the state educational standard of higher professional education and the level of his training;

making a decision on awarding a qualification (degree) based on the results of the final state certification and issuing an appropriate state diploma of higher professional education to the graduate;

12. The State Attestation Commission for the main educational program of higher professional education consists of examination commissions for the types of final attestation tests provided for by the state educational standards of higher professional education.

By decision of the academic council of a higher educational institution, several examination commissions can be formed for final attestation tests, and several state attestation commissions can be organized for one main educational program of higher professional education.

A representative of the higher educational institution is included in the composition of the state attestation commission of the branch of the university as a deputy chairman.

13. Examination commissions are formed from the teaching staff and researchers of the graduating higher educational institution, as well as persons invited from third-party organizations: specialists from enterprises, institutions and organizations - consumers of personnel of this profile, leading teachers and researchers from other higher educational institutions.

The chairmen of the examination committees for certain types of final certification tests are the deputy chairmen of the state certification committee.

The composition of the examination committees for certain types of final attestation tests is approved by the rector of the higher educational institution.

IV. The procedure for conducting the final state certification

14. The procedure for conducting state certification tests is developed by a higher educational institution on the basis of these Regulations and is brought to the attention of students of all forms of education no later than six months before the start of the final state certification. Students are provided with programs of state examinations, they are provided with the necessary conditions for preparation, consultations are held.

15. The defense of the final qualifying work (with the exception of works on closed topics) is held at an open meeting of the examination committee with the participation of at least two-thirds of its members. The procedure for taking state examinations is established by the higher education institution (except in cases where this is established by the federal education authority in charge of the higher education institution).

The results of any of the types of certification tests included in the final state certification are determined by the marks "excellent", "good", "satisfactory", "unsatisfactory" and are announced on the same day after the protocols of the meetings of the examination commissions are drawn up in the prescribed manner.

A person who has successfully completed the full development of the main educational program in the areas of training (specialty) of higher professional education, developed by a higher educational institution in accordance with the requirements of the state educational standard of higher professional education and has successfully passed all other types of final attestation tests, is allowed to defend the final qualification work. .

16. The decision to award a graduate a qualification (degree) in the field of study (specialty) and issue a state-recognized diploma of higher professional education is taken by the state certification commission based on the positive results of the final state certification, drawn up by the protocols of the examination commissions.

Decisions of the state attestation and examination commissions are taken at closed meetings by a simple majority of votes of the members of the commissions participating in the meeting, with the obligatory presence of the chairman of the commission or his deputy. At equal number of votes the chairman of the commission (or the deputy chairman of the commission replacing him) has the right of a decisive vote.

All decisions of the state attestation and examination commissions are documented in protocols.

17. Persons who have completed the mastering of the main educational program and have not confirmed the compliance of the training with the requirements of the state educational standard of higher professional education when passing one or more final attestation tests, upon reinstatement at the university, repeated final attestation tests are assigned in the manner determined by the higher educational institution.

18. It is expedient to appoint repeated passing of the final certification tests not earlier than three months and not more than five years after passing the final state certification for the first time.

Repeated final attestation tests cannot be appointed by a higher educational institution more than twice.

19. Persons who did not pass the final certification tests for a good reason (due to medical indications or in other exceptional cases, documented), should be given the opportunity to pass the final attestation tests without expulsion from the university.

Additional meetings of state attestation commissions are organized within the time limits established by the higher educational institution, but no later than four months after the application is submitted by a person who did not pass the final attestation tests for a good reason.

20. Reports on the work of state attestation commissions are heard at the academic council of a higher educational institution and, together with recommendations on improving the quality of professional training of specialists, are submitted to the founder within two months after the completion of the final state attestation. The protocols of the final state certification of graduates are stored in the archives of the higher educational institution.
